A customer who slipped and fell at a Shop Smart in Myrtle Creek is suing the store for alleged neglect in the October 2016 incident.

Crabtree is suing for $300,000 in economic damages and $127,000 in non-economic damages.

The lawsuit alleges Brittany Crabtree slipped and fell on a wet surface that accumulated under a leak in the roof, according to court documents.

The Idiart law firm in Medford filed the lawsuit on Oct. 12. The lawyer on the case, Justin Idiart, declined to comment.

Representatives from Shop Smart’s parent company, Medford-based C&K Markets, said they could not speak to the case because it is considered ongoing litigation.

According to court documents, the lawsuit said Shop Smart was negligent in failing to properly fix the leak in the roof, to remove the wet mat, to warn or protect customers of the hazard and to monitor the condition of the floor.
